{"id":10459,"date":"2026-04-20T11:58:02","date_gmt":"2026-04-20T10:58:02","guid":{"rendered":"https:\/\/mcamps.com\/?p=10459"},"modified":"2026-04-20T15:32:44","modified_gmt":"2026-04-20T14:32:44","slug":"establecimientos-sanitarios-real-decreto-239-2026","status":"publish","type":"post","link":"https:\/\/mcamps.com\/eng\/establecimientos-sanitarios-real-decreto-239-2026\/","title":{"rendered":"Health establishments: amendments following the publication of Royal Decree 239\/2026"},"content":{"rendered":"<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Last March, the B.O.E. published in the Spanish Official State Gazette the\u00a0<strong>Royal Decree 239\/2026 of 25 March<\/strong>, amending Regulation (EC) No <strong>Royal Decree 1277\/2003 of 10 October 2003<\/strong>.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This regulatory update introduces measures aimed at <strong>enhancing patient safety<\/strong>, ensuring that the <strong>health care<\/strong> is provided exclusively by professionals with the appropriate formal qualifications and competences.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The<em> <strong>Royal Decree 1277\/2003, of 10 October, establishing the general bases for the authorisation of health centres, services and establishments.<\/strong><\/em> is a regulation, drawn up by the Ministry of Health and Consumer Affairs, which regulates the operating requirements and management of healthcare establishments. It pursues 3 main objectives: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a) <strong>To regulate the general bases of the procedure for the authorisation of health centres, services and establishments.<\/strong> by the autonomous communities.<\/li>\n\n\n\n<li>b) <strong>Establish a common classification, designation and definition for all health centres, services and establishments.<\/strong>, The creation of a general register is a prerequisite for the creation of a general register.<\/li>\n\n\n\n<li>c) <strong>Establishing the General Catalogue and Register of health centres, services and establishments.<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong><em>Royal Decree 239\/2026, of 25 March, amending Royal Decree 1277\/2003, of 10 October, establishing the general bases for the authorisation of health centres, services and establishments.<\/em><\/strong>, was published last March and essentially proposes a number of changes to the 2003 text, aimed at strengthening patient safety. When does it come into force? <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong><em>Royal Decree 239\/2026, of 25 March, amending Royal Decree 1277\/2003, of 10 October, establishing the general bases for the authorisation of health centres, services and establishments.<\/em><\/strong> proposes some changes to the wording of Royal Decree 1277\/2003. Some of them offer a small update of the text, such as the new wording of the minimum common requirements for the authorisation of the installation, operation or modification of a health centre, service or establishment. Or the changes in Annex II, relating to the range of care on offer. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other cases, changes published in the <strong><em>Royal Decree 239\/2026<\/em><\/strong> The new rules are more far-reaching, and they set out a new way of operating that we will have to take into account in order to comply with the regulations. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among them, we would like to highlight that: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A <strong>Article 7, on Guarantees of health care<\/strong>, patient safety oriented<\/li>\n\n\n\n<li>Includes <strong>2 additional provisions<\/strong>: \n<ul class=\"wp-block-list\">\n<li>First additional provision.Information on health personnel.<\/li>\n\n\n\n<li>Second additional provision.Adaptation of the range of care on offer.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, the <strong><em>Royal Decree 239\/2026<\/em><\/strong> sets a date for its entry into force: next year. <strong>1 July 2026<\/strong>.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link wp-element-button\" href=\"https:\/\/mcamps.com\/eng\/contacto\/\">Do you have questions about the authorisation of health care establishments?
