New European directives, regulations and standards are redefining what it means to<strong> to be a responsible company in the 21st century<\/strong>. This phenomenon is not unknown to the <strong>cosmetics and pharmaceuticals sector<\/strong>, two industries that are closely scrutinised due to their environmental impact, their global supply chains and growing pressure from environmentally conscious consumers.<br>One of the key players in this regulatory change is the <strong>CSRD Directive<\/strong> (Corporate Sustainability Reporting Directive), which replaces and expands on the former <strong>Spanish Law 11\/2018 on non-financial information statements (EINF)<\/strong>, the well-known sustainability reports.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These new regulations, which <strong>was due to be transposed in 2024<\/strong>, means:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The adoption of mandatory reporting standards (ESRS), which are currently under review with a view to simplifying them.<\/li>\n\n\n\n<li>The extension of the scope: this will potentially affect more than 49,000 businesses in the EU (also under review).<\/li>\n\n\n\n<li>New reporting formats: the use of XHTML with iXBRL tagging will be required, which will necessitate the use of specific software.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Given the complexity of its implementation, a modification known as the<strong> Directive <\/strong>\u2018<strong>\u2019Stop the Clock\u2019,<\/strong> the aim of which is to reduce the administrative burden on businesses. This proposal also affects another key piece of legislation: the <strong>Directive on due diligence in corporate sustainability (CS3D or CSDDD)<\/strong>).<\/p>\n\n\n\n<figure class=\"wp-block-image alignfull size-full\"><a href=\"https:\/\/mcamps.com\/wp-content\/uploads\/2025\/06\/Post-petita-MCamps-ampla-12.jpg\"><img decoding=\"async\" width=\"900\" height=\"250\" src=\"https:\/\/mcamps.com\/wp-content\/uploads\/2025\/06\/Post-petita-MCamps-ampla-12.jpg\" alt=\"Tsunami regulatorio en sostenibilidad cosm\u00e9tica farmacia\" class=\"wp-image-10275\" title=\"\" srcset=\"https:\/\/mcamps.com\/wp-content\/uploads\/2025\/06\/Post-petita-MCamps-ampla-12.jpg 900w, https:\/\/mcamps.com\/wp-content\/uploads\/2025\/06\/Post-petita-MCamps-ampla-12-480x133.jpg 480w\" sizes=\"(min-width: 0px) and (max-width: 480px) 480px, (min-width: 481px) 900px, 100vw\" \/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The challenges of the regulatory tsunami: What does CS3D entail?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Directive (EU) 2024\/1760 of the European Parliament and of the Council of 13 June 2024 on corporate due diligence on sustainability <\/strong>and amending the <strong>Directive (EU) 2019\/1937<\/strong> and the <strong>Regulation (EU) 2023\/2859 (CSDDD)<\/strong>, better known as <strong>CS3D Directive<\/strong>, will require certain companies to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To identify and mitigate social and environmental risks and impacts within its supply chain.<\/li>\n\n\n\n<li>Establish due diligence procedures relating to human rights and the environment.<\/li>\n\n\n\n<li>Adopt transition plans in line with the climate targets of the Paris Agreement.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This will have a direct impact on companies with outsourced production or those that rely on suppliers in third countries, which is common in the cosmetics sector.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Challenges of the Regulatory Tsunami: Other Regulations Under Review<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Alongside the CSRD and the CS3D, the European Commission has proposed simplifications to other key regulations:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>EU Taxonomy<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Report limited to companies within the scope of the CS3D.<\/li>\n\n\n\n<li>Financial materiality threshold to avoid unnecessary reporting.<\/li>\n\n\n\n<li>Simplification of the 70% in the reporting forms.<\/li>\n\n\n\n<li>Greater flexibility in transitional activities.<\/li>\n\n\n\n<li>Adjustments to the DNSH (Do No Significant Harm) criteria, which are key for chemical substances.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>CBAM Regulation (Carbon Border Adjustment Mechanism)<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Exclusion of small importers (less than 50 tonnes per year).<\/li>\n\n\n\n<li>Simplification of authorisation requirements and emissions calculations.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The challenges posed by the regulatory tsunami:<\/strong> <strong>And what about the regulations that have already been approved?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Apart from these proposed amendments, there are others <strong>regulations already in force that will affect the cosmetics and pharmaceutical sectors<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>ESPR Regulations<\/strong>: requires products to be designed to be more durable, repairable and recyclable from the outset. Pending the publication of the delegated acts.<\/li>\n\n\n\n<li><strong>EUDR Regulation<\/strong>: prohibits the sale of products linked to deforestation, such as palm oil, soya or cocoa.<\/li>\n\n\n\n<li><strong>Green Claims Directive<\/strong>: restrict the use of claims such as \u201ceco\u201d or \u201cgreen\u201d if they are not scientifically substantiated.<\/li>\n\n\n\n<li><strong>SFDR Regulation<\/strong>: although aimed at the financial sector, it encourages companies to provide reliable ESG data if they wish to attract investment<br>sustainable.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Adapting to this new regulatory landscape<strong> it is not optional<\/strong>. But it is also an opportunity to stand out, become more competitive and respond to increasingly discerning consumers.
